01 Acceptance of Terms

These Terms & Conditions ("Terms") constitute a legally binding agreement between you ("User", "Customer", "you") and Rasathar Fragrances ("Rasathar", "we", "us", "our"), a business registered in Rajasthan, India.

These Terms apply to all visitors, users, and customers who access or use our website, purchase our products, or interact with us through any channel. Your continued use of our services constitutes acceptance of any updates to these Terms.

02 Eligibility

By using our website and services, you represent and warrant that:

• You are at least 18 years of age, or have obtained parental/guardian consent
• You have the legal capacity to enter into binding contracts under the laws of your jurisdiction
• You are not accessing our services from a jurisdiction where it would be prohibited
• All information you provide is accurate, current, and complete

We reserve the right to refuse service, close accounts, or cancel orders at our sole discretion if eligibility requirements are not met.

03 Account Responsibilities

If you create an account with Rasathar, you are responsible for:

• Maintaining the confidentiality of your login credentials (username and password)
• All activities that occur under your account, whether authorised or not
• Notifying us immediately at support@rasathar.com if you suspect any unauthorised use of your account
• Keeping your account information accurate and up to date

Rasathar will not be liable for any loss or damage resulting from your failure to comply with these obligations. We reserve the right to suspend or terminate accounts that violate these Terms.

04 Products & Pricing

Product Descriptions

We make every effort to ensure that product descriptions, images, and ingredient lists are accurate. However, we do not warrant that all information is error-free, complete, or current. Colours may vary slightly due to photography and monitor settings.

Pricing

• All prices are displayed in Indian Rupees (INR) and are inclusive of applicable GST unless stated otherwise
• International prices are shown in the selected currency and are approximate — final charges depend on current exchange rates at the time of payment
• We reserve the right to change prices at any time without prior notice
• In the event of a pricing error, we reserve the right to cancel the order and issue a full refund

Availability

All products are subject to availability. We reserve the right to discontinue any product without notice. If a product becomes unavailable after your order is placed, we will contact you and offer a substitute, back-order option, or full refund.

05 Orders & Payment

Order Acceptance

Your order constitutes an offer to purchase products. We reserve the right to accept or decline any order at our discretion. An order is only confirmed when you receive a written confirmation email from us with an order number.

Payment

• Payment must be made in full at the time of order placement
• We accept Visa, Mastercard, RuPay, UPI, Net Banking, and Cash on Delivery (COD) for eligible orders up to ₹5,000
• All online payments are processed through PCI-DSS certified payment gateways
• For COD orders, payment must be made in exact change to the delivery agent

Order Cancellation

You may cancel your order within 2 hours of placement by contacting us. After this window, cancellations are subject to our Return Policy (see Section 7). We may cancel orders in cases of suspected fraud, pricing errors, or stock unavailability.

06 Shipping & Delivery

Shipping timelines, costs, and policies are outlined in our dedicated Shipping & Return Policy. By placing an order, you agree to those terms, which are incorporated into these Terms by reference.

• Risk of loss and title for products pass to you upon delivery
• We are not responsible for delays caused by courier partners, customs authorities, or force majeure events
• Delivery to incorrect addresses provided by you is not our responsibility

07 Returns & Refunds

Our full return and refund process is detailed in our Shipping & Return Policy. Key points include:

• Returns accepted within 7 days for unused, unopened items in original packaging
• Refunds processed within 5–7 business days of receiving the returned item
• Products damaged during shipping are eligible for replacement or full refund
• Sale and discounted items may not be eligible for return — stated clearly at purchase
• Customised or personalised products are non-refundable unless defective

08 Intellectual Property

All content on this website — including but not limited to text, graphics, logos, images, product names, fragrance descriptions, and the overall design — is the exclusive property of Rasathar Fragrances and is protected by Indian and international copyright, trademark, and intellectual property laws.

• You may not copy, reproduce, modify, distribute, or commercially exploit any content without our prior written consent
• You may share links to our pages on social media for non-commercial purposes
• User-generated content (reviews, photos) submitted to us grants Rasathar a non-exclusive licence to use, display, and share such content for marketing purposes

09 Prohibited Conduct

You agree not to engage in any of the following while using our website or services:

• Using automated tools, bots, or scripts to scrape, crawl, or interact with our website
• Attempting to gain unauthorised access to any part of our systems or accounts
• Submitting false, misleading, or fraudulent orders or reviews
• Engaging in any activity that disrupts or interferes with the operation of our website
• Impersonating Rasathar, our staff, or any other person or entity
• Using our platform to distribute spam, malware, or any harmful content
• Reselling our products without prior written authorisation

Violation of these prohibitions may result in immediate termination of your account and potential legal action.

Our website and services are provided on an "as is" and "as available" basis without warranties of any kind, express or implied. Rasathar does not warrant that:

• The website will be uninterrupted, error-free, or free of viruses
• Products will meet every individual's personal olfactory expectations (fragrance is subjective)
• Information on the website is always accurate, complete, or current

Fragrance descriptions are provided for guidance only. Individual experience of scent may vary significantly based on skin chemistry, environment, and personal preference. We strongly recommend ordering a sample before committing to full-size purchases.

11 Limitation of Liability

To the maximum extent permitted by applicable law, Rasathar Fragrances shall not be liable for any indirect, incidental, special, consequential, or punitive damages arising from:

• Your use of or inability to use our website or products
• Unauthorised access to or alteration of your data
• Statements or conduct of any third party in connection with our services
• Allergic reactions to our products (please review ingredient lists and patch test before use)

Our total liability to you for any claim arising out of or related to these Terms shall not exceed the total amount you paid to us in the 12 months preceding the claim.

12 Governing Law & Disputes

These Terms shall be governed by and construed in accordance with the laws of India, specifically those applicable to the state of Rajasthan. Any disputes arising from these Terms shall first be attempted to be resolved through good-faith negotiation.

If a dispute cannot be resolved informally within 30 days, it shall be submitted to binding arbitration under the Arbitration and Conciliation Act, 1996, conducted in Jodhpur, Rajasthan, in the English language.

You agree to submit to the personal jurisdiction of the courts located in Jodhpur, Rajasthan, for any claims not subject to arbitration.

13 Changes to Terms

We reserve the right to update or modify these Terms at any time. Changes will be posted on this page with a revised "Last Updated" date. For material changes, we will notify registered customers by email.

Your continued use of our website or services after any changes constitutes your acceptance of the revised Terms. If you do not agree, please discontinue use of our services.
